This article describes in detail eertain important features of Brazilian intellectual property practiee. This is a useful exeercise not because it is a system wortby of emulation, but for tbe very opposite reason: tbe problematic intellectual property enviroÍl– ment in Brazil is to be avoided, and the government itself now has begun to dismantle tbe existing rules and regulations created in the sbadow of policy driven by import substitution. l.- The Industrial Property Code '" .1' ,:, , The proper plaee to start this overview of tbe Brazilian regulatory regime íor intellectual property is the Código da Propriedade Industrial, which is Law N°S.772 oí Deeember 21, 1971 and which it will hereafter refer to as the Industrial PropertyCode., , Four broad items of ¡ntellectual property protection are covered by the Industrial Property Code: (a) Tbe granting oC privileges -patents- in respect of inventions, useful modeIs, industrial modeIs and industrial designs (Art. 2°); (b) the granting of registrations foi trade and service markS; (e) provisions coneeming the repression of faIse indications of souree; and (d) provisions coneerning the repression oí unfair competition - basical1y providing some statutory protection to unpatented knowbow.
