La zona económica exclusiva: una perspectiva latinoamericana

EL PAPEL DE LAS NEGOCIACIONES INFORMALES EN LA BUSQUEDA . DE UN CONSENSO SOBRE EL DERECHO DEL MAR Vicente Marotta Rangel El contenido creciente del Derecho del Mar Iniciada la Tercera Conferencia de las Naciones Unidas sobre el Derecho del Mar por sesión procesal, que tuvo lugar en Nueva York, del 3 al l S de Di– ciembre de 1973, los resultados que ella está por lograr, después de casi ocho años transcurridos (1), sugieren algunas observaciones concernientes al papel de las negociaciones informales que enseguida pasamos a enunciar. Sin haber tenido desde el principio ningún documento de base, sobre el cual pudiese comenzar, en condiciones objetivas, su inmensa tarea, la Confe– rencia ofrece hoy a nuestra consideración un Proyecto de Convención que consta de 17 partes y 8 anexos. Según se ha señalado, la Conferencia "representa la más ambiciosa, extensa y compleja negociación internacional en la historia" (2). Ella es, por lo menos, "la más singular, la más original, la más indócil a las reglas del género" (3). Su ámbito de competencia ratione materiae excede el campo de las que la prece– dieron.
