EL PAPEL DE LA CIJ EN LA INTERPRETACIÓN DE LA RESPONSABILIDAD CLIMÁTICA Las preguntas planteadas por la Asamblea General a la Corte re- flejan la necesidad de claridad jurídica en cuanto a las obligaciones que tienen los Estados en virtud del derecho internacional de prote- ger el sistema climático y los derechos humanos de las generaciones presentes y futuras frente al daño climático. Debido a la falta de claridad en la ley, la CIJ tendrá que “encontrar” las normas jurídicas aplicables mediante diversas técnicas interpretativas, especialmen- te la de la integración sistémica.
