32 EXPERIENCE IN IMPLEMENTATION OF THE FINANCIAL PROTECTION SYSTEM FOR DIAGNOSTICS AND HIGH-COST TREATMENTS: “RICARTE SOTO LAW” Abstract In 2013, the coverage of high-cost drugs did not have a specific public policy for this group of drugs. In response to this, the first “March of the Sick” was held as a protest manifestation. In 2015, Law Nº20.850 was enacted, which grants guarantees for 27 health problems, including diagnoses, drugs, food and elements for medical use. This law provides an exhaustive body of regulations that includes from the citizen request for coverage to the decision-making of Ministers of Health and Finance. This regulation generated substantive advances in matters of citizen participation, evidence-based health and transparency in decision-making. This law has also created strain situations in the institutional work of the State, by mandating new dialogue between the actors involved, providing certainties regarding the richness of citizen participation, democratization of policy design and implementation spaces and that the transparency of decisions are a baseline for future policies. The chapter systematizes the experience of a stakeholder implementig this regulation from her work in the Chilean Ministry of Health. Keywords: implementation, public policies, Ricarte Soto Law.
